The DOJ announced that Jose Goyos, who was previously found guilty of conspiracy to commit wire fraud and conspiracy to commit money laundering, has been sentenced to 15 years in prison for his involvement in a genetic testing fraud scheme.

A Florida federal jury was presented evidence of how Goyos managed a call center engaged in deceptive telemarketing activities. Evidence presented at trial showed that Goyos and his co-defendants oversaw the  “doctor chase” division of the call center. As the name alludes, Goyos and his co-defendants contacted the primary care physicians of Medicare beneficiaries to trick them into authorizing medically unnecessary genetic tests that were never utilized in the treatment of Medicare beneficiaries. Evidence presented at trial also showed that Goyos directed call center employees to falsely inform physicians that the Medicare beneficiaries had requested the genetic tests and that they had specific medical conditions warranting such testing. In turn, Goyos and his co-defendants used the authorizations obtained from physicians to submit over $67 million in false claims to Medicare. And Medicare paid over $53 million for the foregoing claims.

Goyos will now spend 15 years in federal prison. Nine of Goyos’ co-defendants were previously sentenced for the roles in the scheme and will serve prison terms ranging from 2 to 17 years in prison.
